Article 171: Composition of the Legislative Councils

  1. The total number of members in the Legislative Council of a State having such a Council shall not exceed one third of the total number of members in the Legislative Assembly of that State, but in no case shall it be less than forty.
  2. The composition of the Legislative Council shall be as follows:
  • (a) One-third shall be elected by electorates consisting of members of municipalities, district boards, and other local authorities in the State.
  • (b) One-third shall be elected by members of the Legislative Assembly from among persons who are not members of the Assembly.
  • (c) One-twelfth shall be elected by persons who are graduates of three years’ standing residing in that State.
  • (d) One-twelfth shall be elected by persons engaged in teaching at educational institutions within the State, not lower in standard than secondary school, for at least three years.
  • (e) The remainder shall be nominated by the Governor from among persons having special knowledge or practical experience in literature, science, art, cooperative movement, and social service.
